1. Introduction

These terms and conditions constitute a legally binding agreement between: You, the end user; and Butlins Skills offered by St Endellion Limited, a private limited company registered in Gibraltar under number 100221: registered office - 23 Portland House, Glacis Road, Gibraltar. St Endellion run the Butlins Skills games service in association with St Minver, Gibraltar, ROOT9 MediaLab GmbH, Austria and Trading Solutions, (Arcadelia.com), Sweden.

2. Participation

You must not seek to register for real or play to win real money on any games or tournaments on Butlins Skills or use the chat functionality on this website unless you are at least 18 years of age. Any activity by players found to be under 18 years old will be declared void regardless of any winnings. We reserve the right to request proof of age of any winner of any prize. We shall undertake our best endeavours to ensure that we do not knowingly permit under 18 year olds to wager. Butlins Skills offers games of skill only to the residents of those jurisdictions where such participation is legal. It is your responsibility to ensure that the laws of the country in which you are resident entitle you to play Skill Games. Participation in the game is void wherever prohibited by law.

Employees of St Endellion, St Minver, Root9 and Trading Solutions or anyone connected to the company as a supplier, affiliate, media partner and members of their immediate families are not entitled to play for real at Butlins Skills.

3. Registration

Only one account per person, household and IP address is permitted, and we may use your IP address to monitor that account. We reserve the right to close your account if you in any way attempt to disguise or prevent us from identifying the IP address of the computer that you use to access our site.
In the event that we have reason to believe that a person has opened more than one account, all accounts opened by that person may be closed and all funds received in those accounts pursuant to promotions will be forfeited. You hereby confirm that all information provided to us in your registration and in connection with your account is complete, accurate and not misleading and you agree to inform us immediately if there is any change to such information. This can be done by updating your details in the My Account section of the site.

During registration you will choose a username and password for security purposes. The password that you choose must be kept private and secure by you at all times. Failure to do so could lead to unauthorised activities on your account. Transactions made using your account username and password are accepted by us on the understanding that you are playing the Games. If an alternative source has accessed your account and we are not informed, we accept no liability for monies or information lost or misused.

You may instruct us to exclude you from participation in Butlins Skills using the Contact Us section of the website or by sending a registered letter to Butlins Skills Customer Services, St Minver Limited, Suite 812, Europort, Gibraltar. Use of this opt-out facility will result in your account being blocked. To reactivate your account we may require confirmation from you in writing by fax or email.

4. Your account

In order to play at Butlins Skills, you must open and maintain an account with us.
Any qualified winnings you make on the Games will be credited to your account. You can edit your account and make deposits and withdrawals by accessing the "My Account" facility on this site.

You can deposit monies into your account using credit/debit cards and other forms accepted by WebDollar secure online payments. See www.WebDollar.com for full details of their deposit and withdrawal options and for their terms and conditions. Payments on your account may appear from skillresponse, skills@paymentresponse.com, sr@stenodoc.com, Sean Randal, St Minver or St Endellion. The balance held in your account will not earn interest in your favour. Subject to the provisions of these terms, you can make withdrawals from your account up to your current available balance back to your WebDollar account. In the case of erroneous payouts or system errors leading to an inaccurate account balance we reserve the right to manually adjust your account and inform you of any errors and their rectification. When you close your account, you will be entitled to the return of all funds in it. However, if you do not log onto your Butlins Skills account for a period of 180 days, we may notify you of our intention to close your account and if we receive no response within 14 days thereafter, any balance in your account will be forfeited. Winnings cannot be transferred, substituted or redeemed for any other monies.
Where there is a dispute concerning your account, we reserve the right to suspend the account until resolution is reached. Any disputes must be notified to us in writing stating the date, time and details of the dispute. Any applicable taxes and fees in connection with any winnings awarded to you or any other payments to you are your sole responsibility.

5. Game rules

The game instructions form part of these terms and conditions and can be found on the Controls and Info table for each game.

6. Chat rules

You agree to strictly abide by the following chat rules when using the chat function on the site. Any decision to block a player from being able to participate from entering the Chat Facility is at the discretion of the site manager, whose decision is final. The aim of the Chat Facility is to create a friendly, respectful and welcoming environment for all players.
You shall not use indecent or foul language; you shall not harass, slander or abuse other players; you shall not make racial, sexual or ethnic comments of any kind whatsoever.
You shall not solicit any other players with requests for money, for example by requesting donations to any charitable cause and the like.
Butlins Skills and associated partners Limited shall have no liability to players for any activity occurring in the Chat Facility which may cause any player to suffer loss, damage or distress of any kind.

7. Promotions

From time to time we may operate a bonus promotion. We reserve the right to determine the member qualification criteria of all bonus promotions. Our bonus promotion terms can be found in the Promotions section of the website and are deemed to be incorporated into these terms and conditions. Prize-winners grant us the right to use and publish their user name online and in print in any other media in connection with the game. Acceptance of a prize constitutes permission for Butlins Skills to use winner's name for advertising and promotional purposes without additional compensation unless prohibited by law. All moneys won in Butlins Skills free tournament promotions are Tournament Tokens. Tournament Tokens can then be used to enter real cash tournaments

8. Unlawful acts

Butlins Skills reserves the right, at its own discretion, to void any player winnings if it is determined that a player used software or hardware which is designed, constructed, or programmed specifically for use in obtaining an advantage at playing any game.
Funds accrued from unfair play will not be rewarded to players. Butlins Skills reserves the right to revoke funds won in Free Tournaments or awarded as bonuses by Butlins Skills if foul play is suspected without further explanation.
Any unlawful downloading, copying or use of our website materials including graphics, text, concepts, and methodologies without permission is strictly prohibited and, in particular, you agree to use the website materials solely for your own personal, non-commercial use and specifically not for any business, commercial or public purpose. The deployment within this website of any spider, robot, web crawler or other automated query program; and the re-use and/or aggregation of any of the website materials in the provision of a commercial service without permission is strictly prohibited.
Any attempt by two or more players to gain an unfair advantage over a third player by colluding or playing for intentional loses (cash dumping) in the attempt of money laundering or bonus fund abuse may lead to account suspension or termination.
The Butlins Skills site allows over 18 consenting adults to interact within the confines of the website in a manner deemed appropriate for a games site. Butlins Skills is not responsible and cannot be held liable for inappropriate photos uploaded by players to their profiles or by messages sent between users within the system or on chat. All abuse reported to us will be dealt with strictly. Players accounts may be suspended or shut down for in-appropriate behaviour. Abusive, aggressive, soliciting or otherwise indecent behaviour will not be tolerated.

9. Privacy

We are serious about protecting your privacy. In respect of your personal information (name, email address, home address, etc), this is stored by us on our secure servers in Gibraltar for the sole purpose of providing services to you, as requested by you. We use a variety of security technologies to help protect your personal information from unauthorized use, access or disclosure. We do not sell or lease any of our customer details to third parties. We may use your information to inform you of related promotions which we may be running if you have agreed to receive such e-mails. You are entitled to opt-out from receiving email notification at any time by following the specific instructions in the newsletter you may receive, or via your profile in the "my account" section of our site. We may provide your details to companies who provide services on our behalf, such as other gaming services, software provision, processing transactions etc. We will only provide those companies the personal information they need to deliver the service. They are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose. In rare circumstances, we may be obliged to disclose your personal information if required to do so by law. 10. General

We may, at our sole discretion, make changes to any of the associated games. We also reserve the right to alter, amend or withdraw these terms and conditions, and promotions at our discretion. We will use our reasonable endeavours to notify you of any such changes which are material. We shall not be responsible for any viruses, bugs, cancel-bots, errors or defects in any of our games, systems, software or services which affects your enjoyment of the service or causes any damage to your computer or other personal property. Equally, whilst we use all reasonable endeavours to provide uninterrupted access to the service, we shall not be liable for any downtime which you suffer during your use of any associated games.
